1. Giveaway Description and Duration

The Winter Giveaway by 1620 Workwear, Darn Tough, ErnerBrand, Thorogood, and Badger Tool Belts (the “Giveaway”) is a game of chance. By entering, you will have the opportunity to win a total prize pack worth $2,400. The Giveaway begins at 12:00 AM EST on Monday, November 13, 2023, and ends at 11:59 PM EST on Thursday, November 16, 2023. You will only get one chance to win the giveaway, even if you attempt to submit multiple entries. The Giveaway winner will be chosen and announced by December 15th, 2023.

2. The Giveaway Prize

The total prize pack is worth $2,400 and includes a 1620 Workwear Fleece Lined NYCO Double Knee Utility Pant and Lined NYCO Hooded Jacket ($602 value), Darn Tough Sock Collection ($250 value), ErnerBrand Hammer and Knife Set ($800 value), Thorogood Moc Toe Boot ($250 value), and a Badger Tool Belt ($500 value).

The Prize will be awarded to a single (1) winner with no substitutions, cash equivalents, or other transfers of the Prize being permitted except at the sole discretion of 1620 Workwear, Darn Tough, ErnerBrand, Thorogood, and Badger Tool Belts (the “Companies”). No portions of the Prize are available for returns or exchanges at any of the Companies.

The winner must be 18 years of age or older. The Companies may require, as a condition to awarding the Prize, that you sign a liability statement that agrees to release all the Companies from all losses or injuries of any kind resulting from acceptance, use, or misuse of the Prize.

The Prize is expressly limited to the items and values listed above. It does not include any taxes or other expenses. Other restrictions may apply.

3. Eligibility

To be eligible to enter the Giveaway, you must be (1) a legal U.S. resident, (2) at least 18 years of age at the date of entry, and (3) the age of majority in whichever state you reside at the date of entry. You must also comply with these official Giveaway rules.

Employees of the Companies are not eligible to enter or win the Giveaway. Otherwise, entry is open to anyone that meets the eligibility criteria and complies with these official rules.

To enter the Giveaway, you must have a valid email account and a valid phone number, by which the Companies can contact you.

Any person attempting to defraud or tamper with this Giveaway (electronically or otherwise) or any person that does not comply with these official rules, will be automatically disqualified and ineligible to win the Prize. In the most extreme circumstances, such persons may be prosecuted to the full extent of the law.

4. How to Enter the Giveaway

Visit https://www.1620usa.com/pages/winter-giveaway/ and follow the on-screen instructions. You will need to enter the required information, including an email address and phone number.

Mailing List: by entering the Giveaway, you agree to receive email offers and other marketing messages from the Companies. You may unsubscribe at any time through the links at the bottom of any email from the Companies.

SMS Text List: by entering the Giveaway, you agree to receive marketing text offers from the Companies. You may unsubscribe at any time by either clicking the opt-out link or replying “STOP” to a text message.

By entering the Giveaway, you agree to be bound by these official rules, and to comply with all federal, state, and local laws and regulations. The Companies will not be responsible for lost, late, misdirected, or damaged submissions. Nor will the Companies be responsible for internet, computer hardware or software, phone, or any other technical errors, malfunctions, or delays. Entries that are incomplete, illegible, inaccurate, forged, irregular in any way, or otherwise not in compliance with these official rules will be disqualified. The Companies are not responsible for typographical or other errors in the printing, the offering, or the administration of the Giveaway, these official rules, or in the announcement of the winner.

5. Winner Selection and Notification

The Companies will randomly select one winner from the eligible entries. The Companies will also randomly select a runner-up, who will not be notified or announced (and whose identity will remain strictly confidential) unless the original winner forfeits or is unable to accept the Prize. Odds of winning depend entirely on the number of eligible entries received during the duration of the Giveaway.

On or about December 15th, 2023, the winner will be notified by email that they have won. We will use the email address provided at the time of entry. The winner will be disqualified and forfeit the Prize if:

i. The winner does not respond within 5 days of receiving their notification.

ii. The email is returned as undeliverable.

iii. The winner rejects the Prize.

iv. The winner fails to provide us with the required documentation within the applicable time period.

v. Any of the Companies determines, in their sole discretion, that the winner has not complied with any of these official rules.

If the winner is disqualified for any reason, the randomly selected runner up will be notified, announced as the winner, and awarded the Prize. If the Prize is forfeited, no other compensation will be provided.

6. Use of Personal Information related to the Giveaway

Any information provided when you enter the Giveaway is available only to the Companies. Each of the Companies have additional privacy policies that are available on their respective websites. We may access and use information associated with your Giveaway entry to administer the Giveaway, including the selection, notification, announcement, and verification of the winner, or as otherwise explained in these official rules.

By submitting an entry, you represent and warrant that you meet the requirements and qualifications for the Giveaway, and that you have read and understood these official rules and fully agree to abide by them.

You agree to indemnify and hold the Companies harmless from and against any third-party claim, including attorneys’ fees or costs, arising from any use of your entry.

7. Taxes, Rights, and Other Obligations

At the sole discretion of the Companies, the randomly selected winning entry may be used as part of any informational, marketing, promotional, public relations, or media campaign. Whether broadcasting on television, online, social media, or otherwise, the Companies will be allowed to share without providing compensation to the winner or any other entrant. By winning the Giveaway, however, there is no guarantee that your entry or its contents will be used by the Companies.

By accepting the Prize, the Winner releases and discharges the Companies, as well as their affiliated companies, advertising and promotion agencies, and all their respective employees from any liability or damage due, in whole or in part, to the awarding, acceptance, possession, use, or misuse of the Prize.

8. Issues of Law

Taxes: all federal, state, and local taxes relating to participation in the Giveaway, or the awarding of the Prize are the responsibility of the Winner.

Governing Law: all federal, state, and local laws and regulations are applicable. Entrants that violate these official rules, tamper with the operation of the Giveaway, or engage in conduct detrimental to the Companies, the Giveaway, or any other entrant are subject to disqualification. By entering, entrants agree that all issues and questions around the construction, validity, interpretation, and enforceability of these official rules, participant’s rights and obligations, or the rights and obligations of the United States of America in connection with the Giveaway shall be governed by Massachusetts law, irrespective of the fact that any of the parties is now or may become a resident of or be domiciled in a different state.

Severability: if any provision in these official rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the parties’ fundamental intentions, and the remaining provisions shall not be affected or impaired, provided that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new, legally valid stipulation.

Disclaimers and Limitations: the information and services included in or available through the Companies, or any other media used to promote the Giveaway may include inaccuracies or typographical errors. Changes are periodically made to each of the Companies’ websites and the information therein. The Companies, or their agents, representatives, or contractors, may change their respective websites at any time.

To the maximum extent permitted by law, the Companies, their agents, representatives, and contractors hereby disclaim any warranties, obligations, liabilities, rights and remedies, express or implied, oral or written, arising by law or otherwise, including the warranties of merchantability and fitness for a particular purpose, title, infringement, or any implied indemnities. By entering, you understand and acknowledge that the Companies have not made, and you are not relying on, any express or implied warranties or representations to you regarding the value of the Giveaway or the odds of you becoming a finalist or winner. All data, information, products, services, and graphics related to the Giveaway, these official rules, and the Companies’ websites are provided “as-is, where-is” without technical or other support of any kind.

In no event shall the Companies, or their employees, agents, contractors, or representatives be liable to you or any third party for incidental, indirect, special, consequential, or punitive damages, including without limitation lost profits, monies or a lost Prize, related to the Giveaway or these official rules.

9. Liability Release

Entrants agree that the Companies shall not be liable for, and you hereby discharge and release them from all losses or injuries of any kind resulting from: (1) acceptance or possession and/or use or misuse of the Prize, (2) participation in the Giveaway, (3) individual, joint, or collective technical malfunctions of the telephone network, transmission line, computer online system, computer dating mechanism, computer equipment, hardware or software, (4) any delay or distortion of an entry results from data transmissions that are garbled, incomplete, misdirected, lost, mutilated, delayed corrupted, mechanically duplicated, illegible or otherwise not in compliance with these official rules, or (5) any use or exploitation of your entry in according with these official rules. Entrants also agree that the Companies are not responsible or liable for any injury or damage to an entrant or third person’s computer or mobile device related to or resulting from the Giveaway or its Prize. The Companies are not liable for damage to an entrant’s computer system or mobile device, including without limitation any server failure or lost, delayed, or corrupted data or other malfunction, that might be due either directly or indirectly to an entrant’s participation in the Giveaway.
